Spain’s non-contributory invalidity pension is for people aged 18 to 65 with a disability or chronic illness of 65% or more, who have lived legally in Spain for 5 years, 2 of them immediately before claiming, and who lack sufficient income. In 2026 the full amount is €8,803.20 a year in fourteen payments of €628.80, with the same household limits as the retirement version. With a 75% degree and a need for another person’s help with daily life, a 50% supplement is added, €4,401.60 a year. The most useful feature of this pension is that it allows work: for the 4 years after starting a job or business, the pension is kept as long as pension plus pay does not exceed the twelve-payment yearly IPREM plus the pension, €16,003.20 in 2026; anything above is taken off the pension. With pay of 9,000 euros, for example, the pension drops to €7,003.20 a year and the total is still €16,003.20. If the contract ends, the pension comes back automatically.
Conditions and amount
Article 363 of the General Social Security Act sets four conditions: being between 18 and 65, having lived legally in Spain for 5 years with the last 2 continuous, having a disability or chronic illness of 65%, and lacking sufficient income. The 2026 amount was set by Royal Decree-law 3/2026 and works as for retirement: own income tolerated up to 35%, household limits that rise by 70% per member and are multiplied by 2.5 with children or parents, and a 25% floor.
Working while drawing the pension
Article 366 lets you combine the pension with a job or self-employment for the 4 years after it starts. The ceiling is the sum of the twelve-payment yearly IPREM, €7,200, and the full pension, €8,803.20: €16,003.20 in all. If pension plus pay stays below that, you get both in full; above it, the pension is cut by the excess. The table shows the effect at different pay levels for someone living alone.
| Yearly pay | Pension kept | Yearly total |
|---|---|---|
| €3,000 | €8,803.20 | €11,803.20 |
| €7,200 | €8,803.20 | €16,003.20 |
| €9,000 | €7,003.20 | €16,003.20 |
| €12,000 | €4,003.20 | €16,003.20 |
| €14,000 | €2,003.20 | €16,003.20 |
With pay of €16,003.20 or more the pension disappears for that period: the work rule has no 25% floor like the one that protects against family income. And if the contract ends or the business stops, the pension comes back automatically, without that year’s pay counting towards the recalculation.

The supplement for needing another person
Anyone with a degree of 75% or more who needs another person to eat, dress or get around receives 50% more, €4,401.60 a year. The reduction for pay from a job does not touch that supplement. Imserso lists every amount in its yearly summary. If the minimum living income interests you too, the IMV and disability page compares the two benefits.
Before signing a contract, run the figures with the calculator: knowing the pension you keep helps when negotiating hours, and it shows the point at which extra pay stops adding to your yearly income.
