Spain’s non-contributory retirement pension is for people aged 65 or over who have no right to a contributory pension, or a very low one, and whose income is below the legal limit. Besides age, you need legal residence in Spain for at least 10 years between age 16 and the date of the claim, 2 of them consecutive and immediately before it. In 2026 the full amount is €8,803.20 a year in fourteen payments of €628.80. The sum depends on who you live with. A person living alone with no other income gets the full amount. Living with a spouse or siblings, the household limit rises by 70% per person. And living with your children, which is common at this age, that limit is multiplied by 2.5, leaving room even with average wages: a person with no income living with a son who earns 24,000 euros a year and a grandchild has a limit of €52,819.20 and receives €8,803.20 a year. Someone already on the non-contributory invalidity pension moves to the retirement one at 65 without losing the amount.
The conditions, one by one
Article 369 of the General Social Security Act asks for three things: being 65 or older, living legally in Spain and having done so for 10 years between 16 and retirement age, the last 2 continuous, and lacking sufficient income. Own income must be below €8,803.20 a year and, if you live with relatives, the household’s combined income must stay under the household limit. Payment starts on the first day of the month after the claim.
For this pension the household is narrower than for the IMV: it includes your spouse and blood relatives up to the second degree living with you, but not relatives by marriage: a daughter-in-law or son-in-law living in the home is not part of the household and their income does not count. And the 2.5 multiplier only applies when the people at home include children or parents, that is, first-degree relatives.
| Who you live with | Yearly income limit | Pension if the others earn 15,000 euros |
|---|---|---|
| With your spouse | €14,965.44 | None |
| With one child | €37,413.60 | €8,803.20 |
| With a child and a grandchild | €52,819.20 | €8,803.20 |
| With two children and a grandchild | €68,224.80 | €8,803.20 |

After it is awarded
Every year, before 1 April, the pensioner must file a statement of the household’s income, and the amount is reviewed on it. Changes of address, of people at home or of income must be reported within 30 days. If you rent and hold the lease, also claim the €525 yearly supplement set by Royal Decree 241/2026. And if the household has little income, compare with the minimum living income: the page on the IMV alongside a pension shows how much the IMV can add for the household.
If you meet the conditions but the household income is high, it is worth recalculating whenever the living situation changes: a child moving out can open the right to the pension, and so can a relative’s income falling. A new claim can be filed at any time, and payment then starts from the following month, so there is no reason to wait for the next year.
